Upon full payment for a completed project, clients receive ownership of the final deliverables as agreed. Primate Web FX retains the right to display completed work in our portfolio unless otherwise agreed in writing.

Our Privacy Policy outlines how we collect, use, store, and protect your personal information. By using this website or engaging our services, you consent to the data practices described in the Privacy Policy, which comply with applicable Canadian privacy law including PIPEDA.

Payment schedules and amounts are outlined in individual project agreements. Work does not begin until an initial deposit is received unless otherwise agreed in writing. All outstanding balances must be settled before final files or site access are transferred to the client.

Refunds are handled on a case-by-case basis as outlined in your specific service agreement. Deposits are generally non-refundable once work has commenced. Any payment disputes must be submitted in writing within 30 days of the transaction date. We will review all disputes fairly and respond within 10 business days.

Invoices not paid within the agreed timeline may result in a pause of active work until payment is received. Primate Web FX reserves the right to apply a late fee as specified in the project agreement.

To ensure projects are completed on time and to the agreed standard, clients are responsible for:

• Providing accurate information, content, and assets required for the project in a timely manner
• Reviewing and providing feedback within the agreed review windows
• Ensuring they have the rights to any content, images, or materials they provide for use on their website
• Maintaining secure access credentials to any accounts handed over at project completion

Delays caused by a client's failure to provide required materials or feedback may affect project timelines and are not the responsibility of Primate Web FX.

This website and all services are provided on an as-is and as-available basis. Primate Web FX makes no warranties, express or implied, regarding the website, its content, or the results of any services provided. We do not guarantee specific outcomes including search engine rankings, lead volumes, or revenue increases, as these depend on factors outside our direct control.

To the fullest extent permitted by applicable law, Primate Web FX is not liable for any indirect, incidental, special, or consequential damages arising from your use of this website or our services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Manitoba, Canada.

For clients outside Canada, any disputes that cannot be resolved directly shall be submitted to binding arbitration conducted in Winnipeg, Manitoba, Canada. Arbitration will be conducted in English in accordance with applicable Canadian arbitration rules. The arbitrator's decision shall be final and binding.

Before initiating any formal dispute process, both parties agree to attempt resolution in good faith through direct written communication. Most issues can and should be resolved this way.

Primate Web FX reserves the right to update these Terms and Conditions at any time. The latest version will always be available at this URL with a revised effective date. Continued use of this website or our services after any changes constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically.
